Welcome to Raceups.

These Terms of Use (“Terms”) govern your access to and use of [Website URL], the Raceups Dashboard, Raceups AI-powered products, paid plans, applications, features, content, and related services (collectively, the “Services”).

Raceups (“Raceups”, “we”, “us”, or “our”) is operated by Raceups — Mayur Gadkari, having its registered/business address at 3rd Floor, Barve Complex, J.M. Road, next to Jangali Maharaj Mandir, Shivaji Nagar, Pune – 411005.

By creating an account, purchasing a plan, or accessing or using Raceups, you agree to these Terms and our Privacy Policy.

If you do not agree with these Terms, you should not use the Services.

1. About Raceups

Raceups is an AI-powered career learning and interview-preparation platform.

Raceups may provide services including:

AI Communication Coach;

AI Human Avatar practice;

AI Voice practice;

AI-powered Mock Interviews;

Introduction, Domain and HR interview rounds;

Resume Review;

ATS Review;

communication feedback;

confidence and performance indicators;

domain-knowledge feedback;

interview assessments;

progress tracking;

improvement recommendations; and

other career-learning and practice tools.

Raceups is intended to support learning, practice, preparation, and skill development.

Raceups is not a recruitment agency, employer, university, examination authority, certification authority, or government employment service, unless expressly stated otherwise for a particular service.

2. Eligibility

You must be legally capable of entering into a binding agreement under applicable law to independently purchase and use paid Raceups Services.

Where a user is under the age at which independent consent or contracting is permitted under applicable law, use of the Services may require the involvement or consent of a parent or lawful guardian.

Raceups may introduce age-verification or parental-consent mechanisms where required.

You must provide accurate information regarding your age where Raceups requests it.

3. User Accounts

Certain Raceups Services require an account.

When creating an account, you agree to:

provide accurate and current information;

maintain the accuracy of your account information;

keep your password and credentials confidential;

not share your account with unauthorised persons;

not allow another person to impersonate you;

notify Raceups if you suspect unauthorised account access; and

comply with applicable usage limits.

You are responsible for activities performed through your account to the extent permitted by applicable law.

Raceups may require additional verification when suspicious or unusual account activity is detected.

4. Account Security

Users must not:

share passwords or authentication credentials;

sell, rent, transfer, or commercially redistribute an account;

attempt to bypass authentication;

manipulate account permissions;

access another user's account;

bypass usage limits;

circumvent subscription restrictions;

exploit security vulnerabilities; or

attempt unauthorised access to Raceups systems.

Raceups may temporarily restrict an account where reasonably necessary to investigate suspected unauthorised access, fraud, abuse, or security threats.

5. AI-Powered Services

Raceups uses artificial intelligence to provide various learning and career-preparation features.

AI systems may:

generate interview questions;

analyse responses;

generate communication feedback;

generate confidence-related indicators;

provide domain-related assessments;

generate resume recommendations;

perform ATS-related analysis;

provide corrections;

create improvement plans;

generate learning recommendations; and

provide other automated outputs.

Artificial intelligence systems are probabilistic and may occasionally produce inaccurate, incomplete, outdated, inappropriate, or unexpected outputs.

Users should independently evaluate important information produced by Raceups AI.

6. No Employment or Selection Guarantee

Raceups does not guarantee:

employment;

job placement;

interview selection;

interview success;

promotion;

salary;

admission;

examination results;

professional certification;

employer acceptance;

ATS selection;

recruitment outcome; or

any specific career result.

Raceups Services are designed primarily for practice, preparation, learning, feedback, and improvement.

A score, recommendation, feedback report, resume assessment, ATS result, confidence score, or mock-interview result should not be interpreted as a guarantee or prediction that an employer will reach the same conclusion.

Actual recruitment decisions are made independently by employers, recruiters, institutions, or other third parties.

7. Mock Interview Services

Raceups Mock Interviews may simulate real-world interview scenarios.

Depending on the product, users may select:

interview domain;

difficulty level;

interview mode;

AI Voice mode;

AI Avatar mode;

interview rounds; or

other available settings.

A simulated Raceups interview is not an actual recruitment interview unless Raceups expressly states otherwise.

Questions and assessments may differ from those used by any particular employer.

8. Communication Coach

The AI Communication Coach is designed to help users practise communication and interview-related skills.

Raceups may provide indicators or feedback relating to areas such as:

communication;

clarity;

confidence;

answer structure;

pronunciation where applicable;

interview readiness; and

improvement areas.

Such feedback is intended as a learning aid and should not be treated as an objective psychological, medical, or professional diagnosis.

9. Resume and ATS Review

Raceups may analyse resumes and other documents using automated systems.

Resume and ATS outputs may include:

formatting suggestions;

keyword analysis;

content recommendations;

readability suggestions;

role-related suggestions;

ATS compatibility indicators; and

other automated feedback.

Raceups does not operate or control the Applicant Tracking Systems used by independent employers unless expressly stated.

Accordingly, a Raceups ATS result does not guarantee that a resume will receive the same score, ranking, or outcome in another organisation's ATS.

10. User Content and Uploaded Documents

Users may submit or upload content such as:

resumes;

CVs;

documents;

text;

interview answers;

audio;

voice input;

profile information;

career information; and

other materials.

You retain ownership of content that belongs to you.

By submitting content to Raceups, you grant Raceups a limited right to process, host, store, transmit, reproduce, or otherwise use that content only as reasonably necessary to provide, secure, maintain, and improve the Services, subject to our Privacy Policy and applicable law.

You represent that you have the necessary rights or permission to upload the content you submit.

You should not upload third-party confidential information, personal data, copyrighted material, or proprietary documents unless you are authorised to do so.

11. Voice, Microphone and Camera Features

Certain Raceups features may require access to:

microphone;

audio;

camera; or

similar device functionality.

Raceups will request the relevant device permission before using such functionality.

Users may disable device permissions through their browser, operating system, or device settings, although doing so may prevent certain features from functioning.

Where recordings or transcripts are retained, their handling will be governed by the Raceups Privacy Policy.

12. Paid Plans

Raceups may offer paid products, subscriptions, plans, credits, usage packages, or other paid Services.

Before purchase, Raceups will display relevant commercial information such as:

plan name;

price;

applicable taxes where relevant;

included features;

usage entitlement;

validity or billing period;

important restrictions; and

other material purchase terms.

Available plans and pricing may change over time.

A price change will not retrospectively alter a transaction that has already been completed, except where permitted or required by law.

13. Credits, Minutes and Usage Limits

Certain Raceups products may operate using credits, minutes, sessions, attempts, or other usage limits.

Examples may include limits relating to:

AI Voice usage;

AI Avatar usage;

Mock Interviews;

Resume analyses;

AI requests; or

other premium functionality.

Applicable limits will be displayed in the relevant plan or product description.

Credits, minutes, or usage entitlements:

are associated with the relevant Raceups account;

may be subject to validity periods;

may not be transferable between users unless Raceups expressly permits it;

may not have independent monetary value;

may be reduced when the relevant service is used; and

may be subject to fair-use and abuse-prevention mechanisms.

Any expiry period or significant restriction applicable to purchased credits or entitlements should be disclosed before purchase.

14. Payments

Payments for Raceups Services are processed through an authorised third-party payment provider.

Depending on available payment methods, users may be able to pay through supported options such as UPI, cards, net banking, wallets, or other payment methods provided by the payment gateway.

Raceups may receive transaction-related information such as:

payment status;

transaction ID;

order ID;

amount;

purchased plan;

refund status; and

other information required for transaction reconciliation.

Raceups does not intend to directly store complete card numbers, CVV/CVC values, card PINs, OTPs, or similar payment-authentication credentials.

15. Payment Verification

A payment being debited from a user's bank account does not necessarily mean that Raceups has successfully received confirmation of the transaction.

Access to a paid Service may be activated after successful verification through the payment provider or Raceups systems.

If payment is debited but the transaction is marked unsuccessful or pending, the user should contact Raceups support with the relevant transaction information.

Raceups may verify payment status with its payment provider before activating a plan, processing a refund, or resolving a payment dispute.

16. Subscriptions and Recurring Payments

Where Raceups offers recurring subscriptions, the applicable billing frequency and renewal terms will be disclosed before the subscription is purchased.

A recurring payment will only be initiated through the payment mechanism authorised by the user and subject to applicable payment regulations.

Where applicable, users may cancel future renewal through the method provided by Raceups or the relevant payment provider.

Cancellation of future renewal does not automatically create a right to refund amounts already paid.

Refund eligibility is governed by the Raceups Refund & Cancellation Policy and applicable law.

If Raceups does not offer automatic recurring subscriptions, this section should be removed before publication.

17. Refunds and Cancellations

Refunds, cancellations, duplicate payments, failed transactions, and related matters are governed by the separate:

Users should review that policy before completing a purchase.

Nothing in these Terms limits any non-waivable rights available to consumers under applicable law.

18. Taxes and Invoices

Prices may be subject to applicable taxes.

Where required or supported, Raceups may issue an invoice, receipt, or payment confirmation for a transaction.

Users are responsible for providing accurate billing or tax information where requested.

19. Promotional Offers

Raceups may occasionally provide:

discounts;

promotional pricing;

coupons;

bonus credits;

trial periods; or

promotional access.

Promotions may be subject to separate conditions, validity periods, eligibility requirements, and usage restrictions.

Unless expressly stated otherwise, promotional benefits cannot be exchanged for cash.

Raceups may prevent fraudulent or abusive use of promotional offers.

20. Acceptable Use

You may use Raceups only for lawful purposes and in accordance with these Terms.

You must not:

use Raceups for unlawful activity;

harass, threaten, or harm others;

upload malicious software;

upload illegal content;

attempt to compromise Raceups security;

probe or scan Raceups systems without permission;

bypass authentication or authorisation;

scrape Raceups excessively;

use bots or automation to abuse the Services;

bypass credits or usage limits;

manipulate billing or payment systems;

attempt payment fraud;

interfere with another user's account;

impersonate another person;

reverse engineer protected systems except where permitted by law;

obtain or attempt to obtain Raceups API keys;

use stolen or unauthorised credentials;

overwhelm Raceups infrastructure;

exploit bugs or vulnerabilities for personal gain; or

assist another person in doing any of the above.

21. API and Automated Access Restrictions

Raceups' internal APIs, authentication endpoints, AI integrations, payment integrations, and infrastructure are intended only for authorised use.

Unless Raceups expressly grants written permission, users may not:

directly call private Raceups APIs;

extract API credentials;

circumvent frontend/backend controls;

automate excessive requests;

bypass rate limits;

interfere with usage metering;

use Raceups infrastructure to access third-party AI services without authorisation; or

reproduce or commercially resell Raceups Services through unauthorised automation.

Raceups may apply technical controls such as authentication, rate limits, usage quotas, fraud detection, IP controls, and request monitoring to protect its systems.

22. Security Research and Vulnerabilities

Users who discover a potential security vulnerability should report it responsibly to:

Users must not exploit a vulnerability to access, copy, modify, destroy, disclose, or extract information that they are not authorised to access.

Raceups reserves the right to investigate suspected security abuse and take appropriate legal or technical action.

23. Intellectual Property

Except for user-owned content and third-party materials, Raceups and its licensors own or control intellectual-property rights relating to the Raceups platform, including where applicable:

brand name;

logo;

website design;

interface;

software;

source code;

proprietary workflows;

prompts;

educational content;

graphics;

databases;

platform functionality; and

original content.

These Terms do not transfer ownership of Raceups intellectual property to users.

Users receive only a limited, revocable, non-exclusive, non-transferable right to use the Services for their permitted personal or authorised business/educational purpose.

24. Restrictions on Raceups Content

Unless expressly permitted, you may not:

commercially reproduce Raceups content;

resell Raceups Services;

copy proprietary learning material in bulk;

redistribute premium content;

remove copyright or trademark notices;

falsely claim Raceups content as your own; or

create an unauthorised commercial derivative of Raceups proprietary content.

Normal personal notes, screenshots, or study use may be permitted where they do not violate applicable law, intellectual-property rights, or these Terms.

25. Third-Party Services

Raceups may rely on or integrate with third-party services such as:

artificial-intelligence providers;

voice technology providers;

avatar technology providers;

hosting providers;

payment providers;

email providers;

analytics providers;

authentication services; and

cloud infrastructure.

Availability of certain Raceups features may depend on those providers.

Third-party services may also be governed by their own terms and privacy policies.

Raceups is not responsible for independent third-party services outside its reasonable control, subject to applicable law.

26. Service Availability

Raceups aims to provide reliable access but does not guarantee uninterrupted or error-free availability.

The Services may occasionally be unavailable because of:

maintenance;

updates;

internet failures;

cloud-provider outages;

third-party API outages;

security incidents;

technical problems;

upgrades;

events beyond reasonable control; or

other operational reasons.

Raceups may perform planned or emergency maintenance where necessary.

27. Changes to Features

Raceups is an evolving technology platform.

We may:

add features;

improve features;

modify interfaces;

replace technology providers;

discontinue obsolete functionality;

change usage limits;

modify product structure; or

introduce new services.

Where a material change adversely affects an existing paid entitlement, Raceups will handle the matter in accordance with applicable law and the relevant purchase terms.

28. Account Suspension and Termination

Raceups may restrict, suspend, or terminate access where reasonably necessary if:

these Terms are materially violated;

an account is used fraudulently;

payment fraud is suspected;

account sharing is abused;

platform security is threatened;

usage limits are deliberately circumvented;

another person's rights are violated;

required by law; or

continued access creates a material security or operational risk.

Where appropriate and legally required, Raceups may provide notice or an opportunity to resolve the issue.

Users may request account closure in accordance with the Raceups Privacy Policy.

29. Effect of Account Termination

After termination or deletion:

access to the account may stop;

unused benefits may be handled according to the applicable plan and Refund & Cancellation Policy;

eligible personal data may be deleted or anonymised;

legally required records may continue to be retained; and

provisions that by their nature should survive termination may remain effective.

30. Disclaimer of Warranties

Raceups provides Services for learning, practice, career preparation, and related purposes.

To the maximum extent permitted by applicable law, Raceups does not warrant that:

AI outputs will always be accurate;

every question will be suitable for every employer;

every ATS analysis will match third-party systems;

every feature will operate without interruption;

every error will be corrected immediately; or

use of Raceups will result in employment or another specific outcome.

Nothing in this section excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded.

31. Limitation of Liability

To the extent permitted by applicable law, Raceups will not be liable for indirect, incidental, special, or consequential losses arising solely from reliance on AI-generated career-preparation output where such losses were not reasonably attributable to a breach by Raceups.

Raceups does not control hiring or employment decisions made by independent employers.

Any limitation or exclusion contained in these Terms applies only to the extent permitted by applicable law.

Nothing in these Terms excludes liability that cannot legally be excluded or limits statutory consumer rights.

32. User Responsibility

Users remain responsible for:

evaluating AI-generated information;

verifying important factual information;

deciding what to include in a resume;

deciding how to respond in an interview;

safeguarding login credentials;

complying with employer or examination rules; and

ensuring that submitted information is lawful and accurate.

33. Privacy

Use of Raceups is also governed by the:

The Privacy Policy explains how Raceups collects, uses, stores, shares, and protects personal data.

By using Raceups, users acknowledge that personal information will be handled as described in that policy and applicable law.

34. Consumer Rights

Nothing in these Terms is intended to waive or restrict rights that cannot lawfully be waived under applicable consumer-protection law.

Raceups intends to provide material pricing, service, payment, cancellation, and other relevant information in a clear manner so users can make informed purchase decisions.

36. Governing Law

These Terms are governed by the laws of India.

Nothing in these Terms affects mandatory rights or remedies available to consumers under applicable Indian law.

37. Jurisdiction

Subject to applicable consumer-protection laws and other mandatory legal rights, courts having competent jurisdiction in:

shall have jurisdiction over disputes relating to these Terms or the Raceups Services.

This provision does not prevent a consumer from exercising any right to approach a competent consumer commission, regulatory authority, or other forum where such right is provided by applicable law.

38. Changes to These Terms

Raceups may update these Terms to reflect:

changes to its products;

new features;

changes to pricing or commercial models;

changes to payment systems;

security requirements;

technology changes; or

changes in applicable law.

The latest version will display the updated effective date.

Where a material change requires additional notice or consent under applicable law, Raceups will provide it.

Continued use after an effective update may constitute acceptance where legally permitted.

39. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

40. Entire Agreement

These Terms, together with the Raceups Privacy Policy, Refund & Cancellation Policy, and any plan-specific terms shown at the time of purchase, form the agreement governing the use of the relevant Raceups Services.

If specific product terms conflict with these general Terms, the specific terms will control for that particular product to the extent of the conflict.
